Ruth is a Senior Associate within the dispute resolution department. She has appeared before all levels of the Isle of Man High Court and has a diverse range of experience in civil, commercial and public law litigation including:
- commercial disputes
- applications for injunctive relief
- regulatory matters
- personal injury, professional negligence and medical negligence
- human rights
- doleance claims
Ruth also has experience of advising in bankruptcy and liquidation matters, in particular in respect of recognition of foreign office holders and enforcement of foreign judgments.
Ruth has a Master of Laws degree from BPP University in the Law relating to Fraud and Financial Crime and has an extensive background in offshore life assurance.
Notable cases in which Ruth has been involved include:
Adenaike v Department of Home Affairs (Prison Operations) & The Chief Constable of the Isle of Man Constabulary (Civil Division) [2017 MLR Note 11] – successfully acted for a defendant in a claim under the Human Rights Act 2001. This is the leading Manx judgment on the law of limitation under the Human Rights Act 2001.
Adenaike v Department of Home Affairs & The Chief Constable of the Isle of Man Constabulary (Staff of Government Division) [2018 MLR 155, SGD] – successfully acted for a respondent in an appeal against the a decision of the lower court in exercise of its discretionary case management powers and ancillary human rights issues. In particular, the Staff of Government Division provided a concise summary of its jurisdiction to interfere with the discretion exercised by the lower court, which has been subsequently cited with approval.
Adenaike v Department of Home Affairs & The Chief Constable of the Isle of Man Constabulary (No 3) (Staff of Government Division) [2018 MLR 255] – successful application for an extended civil restraint order. This is the leading reported Manx judgment on the court’s jurisdiction to grant extended civil restraint orders and which provides guidance on the preconditions for granting such orders.
